Terms of use
Last updated
These terms apply to the iPhone app Migraine Tracker: Headache Pal and to this website. They include the app's license agreement (EULA). By downloading or using Headache Pal you agree to them.
“Headache Pal”, “we” and “us” mean the app and its developer. “You” means the person using the app.
Which app this covers
- iPhone: “Migraine Tracker: Headache Pal” on the Apple App Store. Apple’s standard Licensed Application End User License Agreement also applies. These terms are between you and us, not Apple; Apple is not responsible for the app or its content, and has no obligation to provide support for it.
- This website: headachepal.com.
Not medical advice
Headache Pal is not a medical device and does not give medical advice. It does not diagnose, treat, cure or prevent any condition. Insights, patterns, reports, the Library and Kip’s replies are for information and self-tracking only, and they can be incomplete or wrong.
- Talk to a doctor or pharmacist about your headaches and your medicines.
- Never start, stop or change a medicine because of something in the app.
- If you have a sudden, very severe headache, a headache after a head injury, or a headache with fever, a stiff neck, confusion, weakness, trouble speaking or changes in vision, get emergency help right away (for example 911 in the US or 999 in the UK).
Kip, the AI companion
Kip’s chat uses artificial intelligence. Replies are generated automatically and may be wrong or not right for you. Kip is not a doctor, nurse or therapist, and is not for emergencies. The chat only works after you agree in the app; the privacy policy explains what is sent.
Using the app
We give you a personal, non-transferable license to use Headache Pal on Apple devices you own or control, for your own use, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions. Please do not copy, resell, modify or reverse engineer the app, get around its purchase checks, misuse the AI chat, or use the app in a way that breaks the law or the App Store rules.
Free and Pro
Headache Pal is free to download. Logging headaches, the calendar, the daily check-in, widgets, the evening reminder, attack mode, the breathing exercise, the Library, Apple Health, 30-day insights, a PDF of your logs and 3 messages with Kip are free. Headache Pal Pro is an optional subscription that adds unlimited chat with Kip, the doctor report, medicine insights, long-term trends, sleep insights, full history, your own triggers and medicines, and CSV and JSON export. Prices are shown in the app before you buy and can differ by country.
Subscriptions and billing
- Payment is charged to your Apple Account when you confirm the purchase.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
- To manage or cancel, open the iPhone Settings app, tap your name, then Subscriptions. Cancelling stops future renewals; Pro stays active until the end of the period you paid for. Deleting the app does not cancel a subscription.
- If you start a free trial, you are charged when it ends unless you cancel at least 24 hours before. Any unused part of a free trial ends when you buy a subscription.
- Refunds are handled by Apple under its policies, at reportaproblem.apple.com.
- If you reinstall or change iPhones, tap Restore on the Pro card in Settings (same Apple Account).
Your data
Your headache logs stay on your iPhone and belong to you. How the app handles information is explained in our privacy policy. You are responsible for your device, its backups, and any files you export and share.
Our content
Headache Pal, Kip the koala, the app’s design, artwork, text and Library belong to us and are protected by copyright and other laws.
No warranty and limits on liability
We work hard to keep the app accurate and working, but it is provided as it is. To the extent the law allows, we do not promise it will be free of errors or always available, and we are not liable for indirect or consequential losses, loss of data, or decisions about your health made using the app. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived, or liability that cannot be limited by law. If the app fails to meet a warranty that applies by law, you may tell Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation.
Apple
- We, not Apple, are responsible for handling any claims about the app, including product liability, legal or regulatory requirements, consumer protection, privacy, and claims that the app infringes someone’s intellectual property.
- You confirm you are not in a country under a US government embargo or on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Ending these terms
You can stop at any time by deleting the app. These terms end automatically if you break them, and then you must stop using and delete the app. The sections on medical advice, warranty, liability and Apple continue after that.
Changes
We may update these terms when the app changes. We will post the new version here with a new date. If you keep using the app after that, the new terms apply.
Law
These terms are governed by the laws of the place where you live, and the courts there have jurisdiction, unless mandatory law says otherwise.
